Terms and Conditions

These Terms and Conditions ("Terms") govern your use of the website located at www.brookfieldcleaner.com (the "Site") and the dry cleaning, laundering, tailoring, alteration, and suit/tuxedo rental services (collectively, the "Services") offered by Brookfield Cleaners & Tailors ("we," "us," or "our"), located in Portage, Michigan. By accessing the Site, placing an order, or using our Services, you ("you" or "Customer") agree to be bound by these Terms. If you do not agree, please do not use the Site or our Services.


1. Services

We provide garment cleaning, pressing, laundering, tailoring, alterations, and formalwear (suit/tuxedo) rental services. Services may be scheduled, ordered, or requested through the Site, by phone, or in person at our facility. We reserve the right to refuse service for any garment or item at our discretion, including items that are excessively damaged, hazardous, or unsuitable for standard cleaning processes.


2. Drop-Off, Pickup, and Delivery

  • You are responsible for providing accurate information about garment care requirements, stains, or damage at the time of drop-off or order.
  • Estimated completion times are provided in good faith but are not guaranteed. Delays may occur due to order volume, equipment issues, or circumstances beyond our control.
  • Garments not picked up within [Insert Number, e.g., 90] days of the completion date may be considered abandoned and may be donated, discarded, or sold in accordance with applicable Michigan law, at our discretion.
  • If delivery service is offered, additional delivery terms, fees, and windows will be communicated at the time of order.


3. Pricing and Payment

  • Prices for Services are as posted in-store, on the Site, or as quoted at the time of order, and are subject to change without notice.
  • Payment is due at the time of drop-off, pickup, or as otherwise agreed. We accept the payment methods indicated at our facility or on the Site.
  • Additional charges may apply for special treatments, rush service, heavily soiled items, repairs, or alterations beyond the standard scope.
  • For rental items, a rental fee, refundable deposit, and/or late fee schedule may apply, as disclosed at the time of rental.


4. Care and Handling of Garments

  • We use industry-standard cleaning and care methods appropriate to the garment and any care labels provided. However, we are not responsible for damage resulting from manufacturer defects, pre-existing damage, colorfastness issues, trims, buttons, or embellishments not disclosed to us, or from care label inaccuracies.
  • Certain fabrics, dyes, and materials carry an inherent risk of damage, shrinkage, or color loss during cleaning, even when industry-standard methods are used. By submitting a garment for service, you acknowledge and accept this risk.
  • You should remove all personal items, valuables, and non-permanent embellishments from garments before drop-off. We are not responsible for items left in pockets or attached to garments.


5. Liability and Claims

  • Any claim regarding lost, damaged, or improperly cleaned items must be reported to us within [Insert Number, e.g., 7] days of pickup or the scheduled completion date, whichever is earlier. Claims made after this period may not be honored.
  • Our maximum liability for any lost or damaged garment is limited to the lesser of (a) the reasonable depreciated value of the item, as reasonably determined by us, or (b) ten times the cleaning charge for that item. We are not liable for sentimental value, replacement-at-original-cost, or consequential or incidental damages.
  • We are not responsible for delays, loss, or damage caused by events beyond our reasonable control, including fire, flood, power outages, equipment failure beyond ordinary maintenance, or other events of force majeure.
  • Unclaimed tickets/receipts should be retained, as they may be required to process claims or retrieve garments.


6. Formalwear (Suit/Tuxedo) Rentals

  • Rental items remain the property of Brookfield Cleaners & Tailors at all times.
  • Rental periods, due-back dates, and applicable fees will be specified at the time of rental. Late returns may incur additional daily rental charges.
  • Customers are responsible for loss or damage to rental items beyond normal wear, up to the replacement cost of the item, as disclosed at the time of rental.
  • Alterations to rental garments must be performed by us; unauthorized alterations may result in additional charges.


7. Website Use

  • You agree to use the Site only for lawful purposes and in accordance with these Terms.
  • You agree not to misuse the Site, including by introducing viruses or malicious code, attempting unauthorized access to our systems, or interfering with the Site's normal operation.
  • All content on the Site, including text, graphics, logos, and images, is owned by or licensed to Brookfield Cleaners & Tailors and may not be copied or used without our prior written permission.


8. Cancellations and Refunds

Orders may be canceled prior to the commencement of service. Once cleaning, alteration, or other processing has begun, we may be unable to offer a refund. Refund requests will be evaluated on a case-by-case basis at our discretion.


9. Privacy

Your use of the Site and Services is also governed by our Privacy Policy, available at https://www.brookfieldcleaners.com/privacy-policy, which is incorporated into these Terms by reference.


10. Disclaimer of Warranties

THE SITE AND SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NONINFRINGEMENT, EXCEPT AS OTHERWISE REQUIRED BY APPLICABLE LAW.


11. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, BROOKFIELD CLEANERS & TAILORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING UNDER THESE TERMS SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE GIVING RISE TO THE CLAIM.


12. Indemnification

You agree to indemnify and hold harmless Brookfield Cleaners & Tailors, its owners, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your violation of these Terms or misuse of the Site or Services.


13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Kalamazoo County, Michigan, and you consent to the personal jurisdiction of such courts.


14. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Site or Services after changes are posted constitutes your acceptance of the revised Terms.


15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
